One Year Health Guarantee

***Please read over this health guarantee & puppy contract purchase agreement carefully. Before placing a deposit to purchase a puppy, because at pick up you and I will both sign an original copy for each other. This is a legal and binding agreement for both the buyer and the seller to be made in sound mind and with careful consideration.***

One Year Health Guarantee

1.  The buyer agrees to have the puppy examined by a licensed veterinarian at the buyer's expense within the seller’s “grace period” of seventy-two (72) business hours from the time of pick up, failure to do so prevents an established baseline for the health and condition of the puppy with the buyers licensed veterinarian. Not fulfilling this requirement will void this health guarantee portion of this agreement. Proof of buyer's veterinary check must be sent back to the seller via email to goldenevepuppies@gmail.com. Please have your appointment scheduled prior to picking up your puppy to insure this time frame is met and schedule pick-up time accordingly.

2.  The puppy is health guaranteed according to the terms and conditions of this agreement until 11:59 pm on the puppy’s first birthday, against any and all fatal or life-altering congenital defects and/or conditions that adversely affect the health of the puppy. The seller certifies with an accompanying health certificate that, upon buyer receiving the puppy, that it has been health checked, by a licensed veterinarian and is in good health, and is fit for sale.

3.  This first year of life health guarantee covers the following: any and all congenital defects or conditions including; but not limited to: severe hip or elbow dysplasia (which hampers the puppy's movement and natural gait, and which requires surgery to correct), the spine, and vital organs including but not limited to: the brain, heart, kidneys, liver, lungs, spleen, pancreas, stomach, both the large and small intestines, severe generalized Demodex, tracheal atresia, and severe seizure disorder.

4.  Seller will not be responsible for any veterinarian bills acquired in the event the buyer decides to treat any of the above-listed medical conditions instead of immediately returning the puppy.

5.  Any health condition that is considered by a licensed veterinarian to be minor, correctable, or a breed-related common condition, other than those listed in this health guarantee is not covered.

6.  Any conditions which could go away or is a condition which a puppy will likely grow out of per a licensed veterinarian are not covered.

7.  Any conditions caused by an injury or diet after the buyer takes possession are not covered.

8.  The seller certifies that the puppy has been immunized and wormed according to the accompanying health record of said puppy.

9.  Every effort has been made to ensure that your puppy is as healthy as possible, and they have their heart, lungs, other vital organs, bone structure, eyes, teeth, ears, testicles, and skin checked by a licensed veterinarian prior to leaving. However, Golden Retrievers are prone to multiple health problems that are breed-related common conditions. Buyer agrees to accept responsibility for any and all breed-related common health conditions that are not life-threatening or life-altering congenital defects or conditions that adversely affect the health of the puppy and are easily treatable within this (1) year period.

10.  Common health conditions can be found on Golden Retriever Club’s website under the health section or Yourpurebredpuppy.com under Golden Retrievers health.

11.  Although every measure is taken to protect the health of the puppy, in the event the puppy is found to not be in good health, upon buyer taking physical possession of the puppy at any point during the "grace period" then the buyer is to have puppy’s condition verified by a licensed veterinarian and immediately notify seller from the licensed veterinarian’s office by phone for the seller to speak to the veterinarian for verifying a condition “not healthy for sale” and the reason why then seller will retake possession of the puppy provided it is agreeable to both parties and either a full refund or replacement puppy shall be given to the buyer.

12.  In the event of the buyer’s veterinarian does not give the puppy a passing health check showing the puppy fit for sale, the seller reserves the right to have the puppy re-examined by their own veterinarian at their own expense to confirm the buyer’s veterinarian's diagnosis showing puppy was unfit for sale. Any conflict in diagnosis will require a third licensed veterinarian to determine which is diagnosis is the final status of the health condition of the puppy and the cost of any third veterinarian diagnosis will be split between buyer and seller.

13.  In the event the puppy is returned under the conditions of this health guarantee, the buyer has two options available from the seller as a remedy:

            13-1.   the buyer will receive a full refund on the full purchase amount that the buyer paid for the puppy to the seller and the cost of shipping the puppy back will be at the seller’s expense or

            13-2.  the seller will replace the puppy from either the current litter or the next litter of the same breed and size, when it becomes available, and return shipping of the unhealthy puppy shall be the seller’s cost, and shipping of new replacement puppy will be at the seller’s cost.

14.  No cash refunds are given for any returned puppy that does not have a qualifying condition considered as returnable under this health guarantee.

Note**The exemptions to a full refund or return which are not guaranteed or covered in any way to return of the puppy are within the grace period are; any and all conditions caused by injury, conditions caused by neglect, any and all hot/cold temperature related conditions. (For example; heatstroke, exhaustion, dehydration, hypothermia, froze to death, etc…) NO EXCEPTIONS

15.  In the event shipping is required, the Buyer is required to purchase their own means of transportation and the seller requires that the buyer ships via temperature-controlled ground transportation or temperature-controlled pet safe cargo airlines to insure the temperature is safe and water and food accompanying the puppy to the buyer. In the event shipping is required, then it is the buyer’s responsibility upon receipt of the puppy to keep a safe temperature and means of adequate hydration for the puppy ALWAYS.

In the event puppy is found in any type of unhealthy condition immediately upon arrival from shipping, the buyer is to immediately take the puppy to emergency care and notify the seller of the name, location, and the number of the facility treating the puppy. If the condition is determined to be the seller's responsibility then the seller shall cover the costs. If the condition is due to the shipping, the buyer is responsible to remedy the costs with the shipper they chose. 

16.  In the unfortunate event that the puppy does become deceased within this one (1) year guaranteed time frame, the buyer may either; get a replacement puppy for free from the next available litter of the same sex & breed OR exercise the option of a full refund of the purchase price under these conditions: 

IF the buyer pays to have the animal necropsied/autopsied to determine the cause of death and finds the puppy's death is due to one of the above-mentioned health guaranteed covered conditions. A necropsy/autopsy report shall be sent to the seller.

IF the death is found to be caused by a covered condition, the seller reserves the right to a second veterinarian's opinion to determine the cause of death was in fact due to a pre-existing congenital birth condition. The cost of this second opinion shall be confirmed at the seller’s own expense before replacing the puppy.

In the event, the cause of death is concluded by both veterinarians to be caused by a condition covered in this health guarantee, and the buyer chooses the option of a full refund of the purchase price, then the seller has up to 30 days maximum to refund the seller the full cost of the purchase price. This reimbursement will not include any shipping costs paid, veterinary care over the time the buyer had their puppy, nor the cost of necropsy/autopsy. 

Puppies are guaranteed for one year from the date of birth. In the event a puppy is found to have a covered health condition that warrants its return, the buyer's licensed veterinarian must send a certified letter that’s signed and dated with the said non-treatable defects/illness. The buyer must not give/send the letter, doing so will jeopardize the validity of the return of the puppy and possibly void the health contract. The letter must come from a licensed veterinarian and include the veterinarian’s name, address, and telephone number.

** IMPORTANT NOTE: I CANNOT CONTROL WHAT YOU DO WITH YOUR PUPPY AFTER YOU PICK IT UP, BUT I HIGHLY SUGGEST NO PUBLIC AREAS THAT ANY OTHER DOGS WALKED ACROSS IN THE LAST 2 YEARS IF YOU CAN AVOID IT DUE TO HIGH NUMBER OF CASES OF PARVO WHICH WILL LIKELY KILL YOUR PUPPY UNTIL TWENTY-ONE (21) DAYS AFTER LAST VACCINATION AT 16 WEEKS OR LATER. 

Explanation: Parvo survives in soil for one (1) to possibly two (2) years and approximately ninety (90) days on concrete. The buyer should heed these warnings of risks of any unknown ground conditions with all extreme caution as the seller does. It is out of the seller’s control if the buyer does, in fact, place the puppy on contaminated soil, therefore the seller cannot be responsible past the seventy-two (72) hour grace period of any and all communicable diseases such as flu, parvo, distemper, etc... because I cannot control what you do with your puppy... Many buyers want to show off their new puppy at pet stores and parks and this is exactly the worst risk you can do to your puppy being his immune system just started developing and those first puppy vaccinations are only an attempt to start an immune reaction to get antibodies to fight. 

REASON: Puppy has been with the seller for a minimum of 8 weeks upon pick up and has been deemed healthy at departure. The incubation period for viruses is 4-9 days. It has been a minimum of 9 days since the puppy's first vaccination and the puppy is healthy when I hand it to you (or it would not leave my house). This is confirmed by my vet with a signed health certificate stating that I brought the puppy to them to check prior to leaving and it is deemed healthy. Additionally, to fulfill your part of this health guarantee, your vet is going to check your puppy within seventy-two (72) hours to confirm what my vet already stated.

Having said that, if you placed your puppy on public grounds that unknown to you may be contaminated with infectious diseases on your drive home and your puppy gets sick on day 4, then I am not liable for your error in judgment and for not heeding these warnings. I will not get my good reputation of having healthy puppies placed in question because someone did not read this thoroughly, nor do their own research to be knowledgable themselves and  got their new puppy a communicable disease that could/should/would be prevented.

Furthermore, I will supply you with litter pads and gloves to get your puppy from my house to your house without having to put them on public grounds to potty. So if you put your puppy on public grounds before it is fully immune, then it is pure negligence on your part because I print it, say it verbally to you, and provide the means to avoid it. Despite all of this there is always someone every litter that will still risk it on the drive home and some of you will still take your puppy to Pet Smart for training and to show them off by letting them walk on the floor beside you. I just cannot be liable for this type of careless endangerment. 

I am aware that some of you know this information and this is not for you, but it is a fact that some people have never had a kid, nor a puppy and truly this information so it needs to be emphasized and emphasized again because it is literally a matter of life and death. 

For those who do not know; a puppy's immune system doesn't even start developing until 8 weeks of age and the mother's antibodies are what are protecting them up to 2 weeks after weaning. First shots do nothing for immunity and actually weaken their developing immune system while we are simply trying to initiate an immune response to get some personal antibodies made. We do shots every 21 days because that is how long it takes for the body to develop antibodies after exposure to a virus and is the soonest the previous antibodies if any could assist in fighting a virus it's previously been exposed to.

We do this in the hope that any antibodies that were acquired through the first or second shot can increase their numbers up to the age of Sixteen (16) weeks which is when the immune system is finished developing and when we then administer the last "booster" shot that actually is the earliest point in development that one single shot gives them immunity for life. Yes, one shot at 16 weeks or later is the only one that does anything, so your puppy is not immune because they had a first, second, or even third shot prior to 16 weeks. One shot after 16 weeks is when they develop full immunity. I am putting this not in the health guarantee because people do not listen and consistently say they didn't know and risk their puppy's life. Although they leave my house and become your furever baby, I still raised them for 8 weeks and love them and went to all means necessary to protect them so I don't want anything to happen to them that could be avoided by simple knowledge and precautions. I hope you take this as seriously as I do and as it is because I continue to hear from people at the vet's office that Parvo is running rampant. This is another place where it is not safe to put your puppy on the ground because sick puppies walk on the ground into vet's office's and sometimes this does not occur to people either. I am simply trying to save you, me and the puppy from devastation.  

Health Guarantee is valid one (1) year from the date of signing until 11:59 pm of that same day of the following year or until 11:59 pm of the date the puppy reaches one (1) year of age, whichever comes first. One Year Health Guarantee is intended to cover through the completion of the first year of life, covering any health issues that are genetic conditions that are due to the breeding of these specific parents and not intended to cover common conditions known in this breed that the owner should be aware of prior to choosing the breed; unless the common condition is severe, requiring surgery, disabling and/or life-threatening.

Purchase Agreement

Please read the Health Guarantee above and this Purchase Agreement completely before putting a deposit on a puppy. By putting a deposit on a puppy, you are agreeing that you read this document and the accompanying Health Guarantee and that you agree to the terms and conditions here within this agreement between yourself, hereinafter referred to as “buyer” and Amber Boyd, hereinafter referred to as “seller”.

TERMS AND CONDITIONS:

1. Seller requires a three hundred dollar ($300.00) deposit to secure either position on the order of getting to pick a puppy once they pass health checks at 5 to 6 weeks of age OR if after they are 6 weeks of age, it can be applied to a specific puppy after others who placed deposits early have chosen their picks already. Once you actually pick a specific puppy after health checks confirm they are healthy (at approximately 5-6 weeks or later), and are given the specific puppy's microchip number that you chose, the puppy is then placed as unavailable to any other buyers and removed from viewing for the remaining people to pick from. This is the point when the $300 deposit placed becomes non-refundable, the puppy is marked as sold and the deposit is applied toward your balance due at pick up. In the event, you do not find a puppy you feel is a right fit for you at the time 6 week picks takes place, or if you decide prior to that day to forfeit your position to pick a puppy for any other reason, the deposit is refundable within twenty-four (24) hours of notice received of forfeiting your position and will be refunded through the same means that it was paid. (Please note: If you used PayPal, please be advised they take 7-10 days to complete refunds. Venmo and Cash App are immediate upon sending.) Once a buyer chooses their specific puppy at 6 weeks or later, and the buyer then receives the last four (4) digits of puppies microchip number of their specific puppy, the microchip number will be used for verifying which one is the specific puppy they purchased when they arrive at pick up time (usually at 8 weeks). We scan the microchip number in front of the buyer at pick-up to confirm that it is the same puppy they placed a deposit on 2 weeks earlier. This is one, to show the new family where the microchip is located for their vet's information and this is also because in the case of Goldendoodles, the coats & colors change rapidly and the puppy may look different at 8-9 weeks than it did at 5 to 6 weeks. It's just a fun fact about Doodles their coats change 4 to 5 times the first year until adulthood. For this reason, we do not guarantee coat textures or colors. The deposit can be in the form of Cash, Cash App, Venmo, or PayPal. No personal, business, or cashier checks will be accepted. In the event, the buyer is unsure of exactly which puppy they want yet, please be advised that the puppy of your choice will be given on a first-come, first-served basis, in the order of the deposits received. Deposits for the order of picking a puppy can be placed as early as an ultrasound confirms the litter has been conceived (and a minimum number of pups) to hold your position of the pick of the litter at five (5) to six (6) weeks after health checks are completed, but at that point of 6-week picks, you need to know which one you want so the next person waiting to pick after you can have their choice made as well in a timely manner. If everything goes according to schedule, you can expect to pick your puppy out on the day it turns 6 weeks starting with females first at 10 a.m. for the first pick, with 2nd pick starting at 11 a.m., and so on and so forth. The number of females available to pick from will determine what time we start on the first pick of the males on that same day from the same litter. So hypothetically if there are four females in that litter, that started at 10 a.m, then the 1st pick of males of that same litter would start at 2 p.m. In the event that 2 litters are born on the same day, (which happens more often than not), we may need to move one litter's 6-week picks to the day before 6 weeks. We will advise the buyers if this situation arises and coordinate another date with them to pick out their puppy. What we do not want is to go later than the 6-week date. Everyone has waited for 6+ weeks to get to this day and the anticipation is difficult, so waiting an extra day after the expected date is just not considerate of their patience and excitement. So again, please be ready to pick your puppy on the 6-week date listed in the ad at the time slot according to your order of picking. We will have provided updated individual pictures and videos prior to this date at 1, 3, and 5 weeks old for you to prepare for this day of picking out your puppy. Those who are close enough can schedule to come in person and those further away can do a video call. The deposit to hold your place for the pick of the litter after health checks is refundable within twenty-four (24) hours of notice received of forfeiting your position of order to pick a puppy at six (6) weeks. Once a deposit is placed on a specific puppy after six (6) weeks, however, that puppy is removed from availability to be purchased by anyone else, and therefore, the deposit to hold a SPECIFIC puppy is NON-REFUNDABLE because that puppy is no longer available or shown and is considered “SOLD” with a balance due at pick up at eight (8) weeks. Puppies are available to be picked up from the seller at eight (8) weeks of age. The balance is due in total at the time of pick up. Balance can only be in the form of cash, Venmo, or PayPal. If you choose PayPal for payments, please note there is an additional 3% fee. I will take the hit of the fee on deposits, but not on the balance because there is enough time to prepare some other means of payment to avoid that fee by that point. No personal, business, or cashier checks will be accepted at pick up. 2. Once a deposit is placed on a specific puppy at 6 weeks of age or older, the puppy is considered “sold”, no longer available to anyone else and the deposit becomes non-refundable, with the following EXCEPTIONS; If there is a problem with the health of your puppy that falls into the terms and conditions of the accompanying Health Guarantee that deems the puppy was as “not fit for sale”, by a licensed veterinarian either; a.) before final payment and pick up by seller’s veterinarian or b.) within the said seventy-two (72) hours or three (3) business days, whichever is sooner as per this agreement "grace period" from the date and time of receiving the puppy by the buyer's licensed veterinarian. In either case, the buyer will have their choice of a full refund or of transferring that deposit toward another puppy from the current litter or order of pick on a future litter. 3. The puppy must be picked up once becoming available at eight (8) weeks of age. If the buyer has some good cause such as a schedule conflict with a previous plan, then the Seller will hold the puppy for a buyer for up to seven (7) additional days free of charge provided the buyer communicates that extra time is needed. Any additional time after nine (9) weeks of age will require additional boarding fee charges for; food, vaccines, dewormer, and care. A future agreed-upon date of pick up with the seller will be required and cannot be indefinite. In the event, the buyer does not communicate that they cannot pick up at eight (8) weeks or simply does not show up to pick up their puppy once it becomes available at eight (8) weeks based on an agreed-upon date and time of pick up per written or verbal communication, via text or email, then communication for other arrangements will need to be made within seven (7) days of the date puppy reaches eight (8) weeks old. In the event buyer does not make any contact with the seller to make other arrangements and/or does not respond to attempted contact from the seller, within seven (7) days of the puppy’s date of becoming available to be picked up, then on the eighth (8th) day of no call/no show/no response to attempted contact, the buyer forfeits the puppy as well as the already non-refundable deposit that secured the puppy to them up to this point. This scenario would only likely happen in the event of absolutely no communication or response to communication from the expected date of pick up and to the following seven (7) days after. On day eight (8) after the expected date of pick up, if there has still been absolutely no communication at all from the buyer, then the puppy will be made available to another family, and the deposit is forfeited with no option of choosing another puppy without showing good cause to prove this wasn't an act of negligence as a new puppy owner. The good cause would be there was absolutely no way for the buyer to reach the seller by email, text, or phone, or respond to sellers' attempts to contact due to an extenuating circumstance beyond buyers' control, such as death, incapacitation, or incarceration of a buyer from the point after a deposit is made, but before the point of final payment and pick up. This clause is to ensure this puppy can still legally be placed with another family in a timely manner for the puppy's long-term best interest in case of unexpected circumstances. In the event the buyer does communicate that buyer is unable to complete the purchase by paying the remaining balance due for their puppy at the date of pup eight (8) weeks of age available date, then the seller will give the buyer an “Extension Period” of additional fourteen (14) days total until ten (10) weeks of age to finalize the sale. During this two (2) week period, the seller will give the buyer seven (7) day notice via phone or email on day eight (8) of no payment of the balance due that in seven (7) more days, if still unpaid, the buyer then forfeits non-refundable deposit of said puppy and that seller intends to relist puppy up for rehoming. In the event buyer does not have the aforementioned balance paid in full within fourteen (14) days of the puppy becoming available, then on day fifteen (15), all rights and interests in non-refundable deposit as well as in the puppy are forfeited and relinquished. The non-refundable deposit shall be used to further feed, immunize, deworm, and further veterinary care while re-advertising the puppy again most likely for a lower price due to the older age and size. This clause also is to ensure that the puppy is being placed with a family that can afford the health care and maintenance required for a puppy for life.

4. Buyer agrees and understands that breeding rights are given free of charge under the conditions that:

a) any canine, young or old acquired from this seller will be an indoor pet and never live outdoors, in an indoor/outdoor kennel, in a long-term boarding facility, or a "puppy farm". Although the breed is a working-class dog with breeding rights given to the buyer, it is this seller's free choice of what type of breeder I am willing to let my puppies/dogs go to. I am not willing to sell to puppies that will not be guaranteed to be loved, properly cared for, and to receive a quality amount of individual attention. It is my opinion that a single to a low number of dogs spreads out the attention best. As a breeder, I understand sometimes we keep a few until older to determine which one is good to breed and which one is not suited for breeding before we let the unsuited ones that are not right for our program go to new families, so I try to give lead-way for hobby breeders that are working on improving the breed by genetic testing, OFA clearances, etc.. . b) aside from litters from ages newborn to 6 months, the buyer will not exceed a maximum of nine (9) dogs at the residence of the canine purchased in this agreement. Any in tact dogs exceeding this number will be considered "mass breeding" and be a breach of this Purchase Agreement. c) seller approves the dog for breeding based on genetic test results which means if you in fact want to breed you need to have that discussion with me so we can determine the which dogs are prospects and what age is appropriate for breeding. I’m mainly looking for that you did your research and have invested in the health testing to not create genetic conditions that can be prevented with the proper steps. 5. Buyer agrees to not spay or neuter the canine before the minimum age of twelve (12) months earliest, but preferably not before eighteen (18) months at full maturity of bone development. Buyer understands that early spay and neuter is for population control and is not in the long-term best interest of any canines. Buyer understands that long-term research has been conducted on Golden Retrievers by U.C. Davis, that confirmed increases of numerous health consequences directly linked to early spay and neutering of the breed, such as increases in hip dysplasia, hypothyroidism, CCL, and multiple types of cancer including lymphoma. All dogs from Golden Eve Puppies either are Golden Retrievers or have the breed for a parent, so it applies to all of our lines. **Please be certain that you are ready for the time, commitment, and financial responsibility of owning a puppy prior to putting a deposit on one. Please make sure the entire family agrees to acquire a new puppy***
